AI ethics has a language problem. When a company says it takes AI ethics seriously, it could mean it has a published principles document that no one enforces, a compliance team managing regulatory exposure, a genuine internal governance structure with consequences, or a PR position. For any AI ethics commitment, ask one question: what happens if they break it? If the answer is nothing — no third-party audit, no contractual obligation, no regulatory sanction, no redress mechanism for affected people — then the commitment is a statement of preference, not a constraint.
This distinction matters because it changes how you should read everything an AI company publishes about its own conduct. A principles document without enforcement infrastructure is evidence of a communications strategy, not a governance structure. Ethics commitments are cheap to produce and expensive to enforce. Publishing a principles page costs a few days of legal and communications time. Are safety controls technical — built into the model or deployment infrastructure — or purely policy-based? Policy can be overridden. Technical controls are harder to bypass. What happens when commercial pressure conflicts with stated safety limits?
Does the company's observable behaviour match its stated ethics commitments? Where are the documented contradictions — between policy and deployment decisions, between public statements and internal communications that have become public?
Has the company published independent evaluations of model outputs across demographic groups? Are failure modes disclosed — or only accuracy figures on representative benchmarks that exclude edge cases?
Does the company operate within or ahead of applicable regulation — or does it expand into new jurisdictions and use cases before regulation catches up, then treat enforcement as a negotiation? The gap between these two positions is the governance risk.
